The key dates
- January 2025: FDA revokes authorization for FD&C Red No. 3 in food and ingested drugs
- January 15, 2027: deadline for food manufacturers to reformulate
- January 18, 2028: deadline for ingested drugs
Separately, several states have passed or proposed their own restrictions, often with different additives and different dates. California led with the California Food Safety Act, and other states have introduced comparable bills. State law can be stricter than federal law.
Who this actually applies to
The reformulation obligation falls on manufacturers: the companies producing the color, sprinkles or candy. As a bakery, you are a user of those products, not the formulator.
Your practical obligations are about what you buy and, if you make label claims, what you say.
A checklist for a small bakery
- Inventory your colorants. List every color, sprinkle, luster dust and pre-made decoration you use.
- Record the ingredient statement for each one. A photo of the label is enough.
- Flag anything containing Red 3 and ask that supplier about their reformulation plan.
- Check your state separately from federal rules.
- Review annually, or when you add a new supplier.
If customers ask
They will. Two principles:
- Only state what you can verify. Say what is on the ingredient statement, not what you assume.
- Do not make health claims in either direction. You are not required to, and you should not.
"I can tell you exactly what is in the products I use" is a stronger, more credible answer than any claim about safety.
Buying with confidence
Buy from authorized dealers and suppliers who can produce current ingredient information. Grey-market stock often arrives without reliable documentation, which makes answering customer questions impossible.
